Leasing Process

Lease process for a Church body as the lessor or landlord

  1. Identify a need to lease property that falls under the oversight of the body
  2. Obtain Church Council / Board approval to lease
  3. Complete Lease/Licence Application Form and send copy to Presbytery and Synod
  4. Project will be approved by relevant body
    • Presbytery can approve leases up to 3 years (including option terms) and no more that $500,000
    • Uniting Resources Board approves all leases over 3 years and over $500,000
  5. Appoint a legal representative and/or managing agent to act on behalf of the Property Trust
  6. Lease agreement is to be drawn up in name of ‘The Uniting Church in Australia Property Trust (NSW)’ or ‘The Uniting Church in  Australia (Australian Capital Territory) Property Trust and sent to Synod for signing by the Property Trust
  7. Following execution of the lease, all original documents are to be forwarded to URPS for secure retention.

  1. Identify a need to lease property from a third party
  2. Obtain Church Council / Board approval to lease
  3. Complete Lease/Licence Application Form and send copy to Presbytery and Synod
  4. Project will be approved by relevant body
    • Presbytery can approve leases up to 3 years (including option terms) and no more that $500,000
    • Uniting Resources Board approves all leases over 3 years and over $500,000
  5. Appoint a legal representative to act on behalf of the Property Trust and review the lease
  6. Lease agreement is to be drawn up in name of ‘The Uniting Church in Australia Property Trust (NSW)’ or ‘The Uniting Church in  Australia (Australian Capital Territory) Property Trust and sent to Synod for signing by the Property Trust
  7. Prior to completion, contact Risk and Insurance Services to insure the property
  8. Following execution of the lease, all original documents are to be forwarded to URPS for secure retention.

Licence Process For A Church Body As The Licensor Or Landlord

  1. Identify a need to offer a licence in respect of a property that falls under the oversight of the body
  2. Obtain Church Council / Board approval to offer a licence
  3. Complete Lease/Licence Application Form and send copy to Presbytery and Synod
  4. Project will be approved by relevant body
    • Presbytery can approve leases up to 3 years (including option terms) and no more that $500,000
    • Uniting Resources Board approves all leases over 3 years and over $500,000
  5. Appoint a legal representative to act on behalf of the Property Trust and prepare / review the licensing arrangements
  6. The Licence agreement is to be drawn up in name of ‘The Uniting Church in Australia Property Trust (NSW)’ or ‘The Uniting Church in  Australia (Australian Capital Territory) Property Trust and sent to Synod for signing by the Property Trust
  7. Following execution of the lease, all original documents are to be forwarded to URPS for secure retention.
